Terms of Use

THESE TERMS OF USE DESCRIBE YOUR RIGHTS AND RESPONSIBILITIES WHEN USING A NATIONAL CENTER FOR TRANSGENDER EQUALITY WEBSITE. PLEASE READ THEM CAREFULLY.

I. Acceptance of Terms

TransEquality.org, including all site-related content and services and all add-on domains such as TransStudents.org or VotingWhileTrans.org (collectively, “TransEquality.org”) is provided by National Center for Transgender Equality (the “Center,” “we,” “us”). Your use of TransEquality.org is subject to your compliance with the terms and conditions set forth in this Terms of Use agreement (”Terms of Use”), which supplement any additional guidelines or other terms posted by the Center in relation to specific site-related services or content. Although you can access and read portions of TransEquality.org just by visiting the site, you must sign up to use certain TransEquality.org features–such as receiving newsletters or participating in the TONI Project at TransStudents.org. Use of TransStudents.org, VotingWhileTrans.org, and any add-on or subdomains subsequently adopted by the Center is governed by this terms of use policy in addition to any other terms of use policies posted on each of those sites.

Please note that we reserve the right to update or modify the Terms of Use without advance notice by posting a revised Terms of Use to this website. Visitors to TransEquality.org (“you”) can determine whether the Terms of Use has been modified since your last visit by checking the “Last updated” legend posted at the top of the Terms of Use. II. About the Center; Purpose of TransEquality.org

The Center is a a 501(c)3 social justice organization dedicated to advancing the equality of transgender people through advocacy, collaboration and empowerment. NCTE was founded in 2003 by transgender activists who saw the urgent need for a consistent voice in Washington DC for transgender people. As a tax-exempt organization, the Center is prohibited from supporting attempts to influence the outcome of any election for public office. Accordingly, with TransEquality.org, the Center seeks to provide policy resources and information about the Center’s policy work – not to advance the interests of any particular political party or candidate for office.

III. The Center’s Proprietary Rights and Re-Use Policy

You acknowledge and agree that the information and materials presented on or through TransEquality.org will remain the property of the Center and its licensors or providers, and are protected by copyright, trademark, patent, and/or other proprietary rights and related laws, rules and regulations. The materials produced by or for the Center (including photographs, graphics, video and audio content) are protected by copyright as a collective work or compilation under the copyright laws of the United States and other countries. All individual articles, content, and other elements comprising this compilation and produced by or for the Center are also copyrighted works. You agree to abide by all additional copyright notices or restrictions contained in any materials produced by or for the Center. You may re-use individual articles and educational material provided on TransEquality.org for non-commercial purposes only, and only when clearly crediting such works to the National Center for Transgender Equality. No material on TransEquality.org may be re-published, distributed, or otherwise used for commercial purposes without permission. The Marks owned by the Center, whether registered or unregistered, may not be used in connection with any product or service that is not the Center’s.

IV. Links

TransEquality.org provides links to other websites and resources. Because the Center has no control over these sites and resources, you acknowledge and agree that the Center does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. The Center is providing these links to you only as a convenience. The Center has the right but not the obligation to block links from or to TransEquality.org at any time.

V. Claims of Copyright Infringement

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. VII. Jurisdictional Issues

TransEquality.org is controlled and operated by the Center from its principal office in the District of Columbia, U.S.A., and is not intended to subject the Center to the laws or jurisdiction of any other state, country or territory. VIII. Termination

XII. Miscellaneous

These Terms of Use are governed by and construed in accordance with the laws of the District of Columbia, United States of America, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of any court located in the jurisdiction of the District of Columbia, United States of America, and waive any jurisdictional, venue, or inconvenient forum objections to such courts, in any matter arising out of or related to TransEquality.org or these Terms of Use. If any provision of these Terms of Use is found to be unlawful, void or for any reason unenforceable, then that provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of any remaining provisions. The Center may assign its rights and obligations under these Terms of Use. Here is our online privacy policy for information collected through our websites and through email lists. NCTE expects it may need to revise its privacy policy as it develops the features of its sites. NCTE will make reasonable efforts to inform users of any changes, but the spirit of this policy will be maintained, and our policy to never sell, exchange, rent, trade, or give email lists to unaffiliated third parties will never be altered. I. What NCTE Will Do with Your Information

The Center will not sell or share the personal information you provide or we collect through our website to any unaffiliated organization without your permission, with the following exceptions. We may share personal information with third parties who provide services, such as website hosting or other services of an administrative or technical nature, solely for the purpose of providing such services and subject to confidentiality obligations. In addition, we reserve the right to disclose personal information about visitors: if we believe in good faith that the law permits it; to protect the rights, property, safety or security of the Center, our visitors, our registered users or the public; to respond to an emergency; or to enforce any terms of use agreement governing use of a website controlled or operated by us. From time to time, we may send you information from other like-minded organizations whose products or services we think subscribers might find interesting, but we do not exchange, trade, rent, or give email lists to unaffiliated third parties.

II. Mailing Lists

NCTE is committed to providing timely updates to our users by email. We may request information from you to enhance our ability to customize our communications with you so you get the information you want. You will be able to unsubscribe from communications you receive from us at any time by following the directions included in each such communication.

III. If You Submit Information to Public Areas of an NCTE Site

Please be aware that if you decide to disclose personally identifiable information on a publicly-accessible area of an NCTE site (such as the TONI Project community forum), this information may become public. NCTE does not control the acts of other visitors to its sites, so please be cautious when deciding to reveal personal information in a public area of any site. Please contact us if you believe a visitor to an NCTE site is improperly collecting or using information about you or other users.

IV. If You Contribute Money Online

NCTE appreciates and will accept online contributions. Users will be asked to submit contact information for verification purposes. Contact information will be stored in a secure location, and financial information will not be stored except when it is needed for record-keeping purposes.

V. Cookies

A cookie is a small piece of information that a website can store on a computer and later use to recognize a user. The purpose of cookies is to enhance your ability to receive the information you want. NCTE may use cookies to enhance the experience of users. A session cookie expires when a user closes the browser in which the Center’s website was viewed. As with all cookies, users can personalize their browser settings to reject session cookies.

VI. IP Addresses and Log File Data

IP addresses are ID numbers for the location of your computer or network on the internet. Log files are recordings of the traffic to and from a server. NCTE’s servers log IP addresses for systems administration and troubleshooting. We track page hits in the aggregate to track the popularity of pages that people visit. With that information we can improve the quality of the site.

VII. Children’s Privacy

NCTE is concerned about the safety and privacy of children online. Because of this, we will make all efforts to comply with the Children’s Online Privacy Protection Act of 1998 (COPPA). COPPA and its accompanying FTC regulations establish United States federal law that protects the privacy of children using the Internet. We do not and will not knowingly contact or collect personal information from children under 13. Our site is not intended to solicit information of any kind from children under 13, and we will develop our site with the capacity to block acceptance of information from children under 13 whenever age-related information is requested.

It is possible that by fraud or deception by others we may receive information given to us or pertaining to children under 13. If we are notified of this, as soon as we verify the information, we will immediately obtain parental consent or else delete the information from our servers. If you want to notify us of our receipt of information by children under 13, please do so by e-mailing us at ncte@transequality.org.

VIII. Security

NCTE has measures in place to protect against the loss, misuse and alteration of visitor personally identifiable information that is under our control. For example, only select NCTE staff and contracted individuals have access to personally identifiable information provided by visitors to non-public areas of our sites, and are bound by a confidentiality policy when accessing such information. We use industry-standard encryption technologies when transferring and receiving sensitive personal and financial data from our site. Please note, however, that security breaches can occur even if reasonable steps are taken to prevent such breaches; for example, we cannot guarantee that information provided through our sites will not be illegally accessed on our servers or intercepted while being transmitted to us over the Internet. Please contact us if you believe there has been any breach of the security of our sites.

IX. Please Note

NCTE plans to regularly update and add new features to our websites. Because of this, NCTE expects to revise its privacy policy as its site develops.
